ABOUT THE ROLE At our core, Mondia Pay is a FinTech company, processing payments for global & local merchants in emerging markets and connecting those to our trusted payment provider partners. We are seeking someone great to help us fulfill our mission of growing the digital economy and drive financial empowerment by providing technologies enabling safe and convenient payments between merchants and their consumers around the globe. We are looking for a dynamic candidate for the position as our Head of Legal and Compliance. The person will on the one hand act as the leading contract negotiator and legal advisor to the commercial team and to mPay\xe2\x80\x99s management and on the other hand as the Compliance Officer ensuring compliance of the company with all statutory laws & regulations. The responsibilities shall further include:
  • Compliance responsibilities:
    • Development of a Compliance Strategy and assuming accountability for its success.
    • Building and developing a Compliance Management System in accordance with ISO 37301 and working towards a respective ISO certification.
    • Developing and maintaining a Regulatory Compliance Process and Regulatory Change Management process, inter alia by
      • Reviewing all relevant statutory laws and regulations applicable to the Company, documenting those in a Regulatory Obligations Register and facilitating compliance with these;
      • Evaluating existing business activities and advising on new market entries, ensuring that all activities are conducted in conformity with all applicable laws, regulations, internal policies and procedures; and
      • Ensuring that all regulatory permissions, registration and licenses remain current and appropriate for business needs.
    • Conducting Compliance Risk Assessments and development of internal policies, procedures, controls, compliance training and protocols to mitigate identified risks;
    • Serve as liaison for all regulatory bodies as well as maintaining relationships with relevant bodies and trade associations;
    • Liaise with 3rd parties (e.g. customers) that wish to understand the company\xe2\x80\x99s control environment, compliance policies and procedures and act as the single point of contact for 3rd party audits.
    • Supporting management in establishing a Compliance culture, developing an annual compliance communication plan and preparing relevant communications.
    • Monitor the status and success of the Company\xe2\x80\x99s compliance program and provide reporting about it to the Company\xe2\x80\x99s executive management and its supervisory;
  • Legal function responsibilities:
    • Provide legal advice and guidance to the company\'s management team on all legal matters, e.g. related to corporate governance, contracts, compliance, regulatory, and other legal issues.
    • Draft, review, and negotiate contracts, and other legal documents related to the company\'s business operations, in particular agreements with merchants and payment providers for the provisioning of payment facilitation and content reselling services.
    • Manage litigation and disputes involving the company, including coordinating with outside counsel as necessary.
    • Coordinate with external legal counsel and outside advisors on matters related to the company\'s legal affairs.
    • Provide legal support for mergers and acquisitions, joint ventures, and other strategic initiatives.
    • Advise the company\'s management team on legal risks and potential liabilities associated with business decisions and transactions.
Requirements
  • Bachelor\xe2\x80\x99s Degree in Law
  • A minimum of 5 years working experience with at least 3 years in the financial services or telecommunications environment
  • I.T knowledge (particularly in Office 365)
  • High level of determination and tenacity
  • Good understanding of Compliance requirements in the Financial Services industry
  • Experience of developing and managing compliance monitoring programmes
  • Articulate, effective communication skills with the ability to communicate internally and externally (lawyers, regulators, auditors) at all levels
  • Strong managerial and leadership abilities to interact with multiple geographically spread teams from the HQ, whilst simultaneously managing other stakeholders
  • A passion to build things from the scratch and not just handle a pre-existing infrastructure
  • Strong problem solving skills and an ability to deliver results under pressure
  • Excellent communication and interpersonal skills, having the confidence to challenge the different teams across the organization
