Gilead's Middle East affiliate is seeking a Director and Head of Legal and Compliance reporting to the Head of Intercontinental (ICR) Legal and Compliance who is responsible for legal and compliance in the Middle East region, Brazil, LatAM, Turkey, Russia, 5 Asian countries and the Global Patient Solutions region.

The role is a leadership role with high exposure at Middle East Affiliate level as well as at a Global, International and ICR level. In parallel, it is an operational role with accountability for personally delivering and overseeing delivery by Middle East Legal and Compliance Department of a high volume of legal support on a wide array of issues which will require a responsive, hands-on mentality and approach.

A key responsibility of the Legal Director is to be a legal advisor and business partner to the General Manager (GM) of the Gilead Affiliate in Middle East, the Affiliate Leadership Team members and functional leadership team members.

The Legal and Compliance Director will also be part of the ICR Legal Leadership Team.

Essential Duties and Job Functions

Supports the affiliate team in delivering optimal performance and operational excellence while ensuring that all major legal and substantial compliance risks are properly understood by the function and serves as a key business partner to the Middle East LT across therapeutic areas and functions.

Ensures efficient and consistent Legal & Healthcare Compliance Policies & Processes are in place and is responsible for setting direction for the improvement, implementation and general maintenance of the Legal and Commercial Compliance systems that support multiple functions.

Knowledge, Experience and Skills

Gilead is looking for an experienced leader ideally from the biotech and/or pharmaceutical industry. With a region that spans multiple countries with diverse cultures, reimbursement policies and regulatory environments, we are seeking an experienced individual with proven cultural adaptability. The successful candidate will have gained experience at an operational level, such as Country/Affiliate General Counsel. Ideally the successful candidate will have gained exposure to working with an international organization, as well as experience with operations in major markets worldwide. The role is based in Dubai, United Arab Emirates (UAE).

Job duties include:

To attend and actively contribute to discussions and decisions at all Middle East LT and ICR Legal Leadership Team meetings, providing highly responsive legal and business partner support.

To lead and to manage the Legal & Compliance function in the Middle East region.

To be a "wise counsel" bringing good judgement and common sense and offering practical legal solutions to challenges Gilead is facing.

To be a Legal and Healthcare Compliance advisor to Gilead Middle East, providing oversight and being accountable for compliance of the day-to-day activities of the Affiliate (including its interactions with healthcare professionals (HCPs., commissioners, patient groups and other stakeholders) with Gilead's policies and with applicable laws, regulations and codes, meeting transparency obligations regarding payments made to HCPs and healthcare organisations (HCOs)), FCPA compliance and operation of internal processes and appropriate monitoring activities to pro-actively identify and address any potential Healthcare Compliance risks.

To support the Affiliate's Business Units, Market Access team, Commercial Operations and functional departments (Medical, Regulatory, Finance, Government and Public Affairs and HR) on all legal matters, with an analytical approach, strong attention to detail, excellent drafting, negotiation and communication skills.

To represent the company as a credible leader in meetings with key Government departments of Health authorities' stakeholders when required.

To oversee and support management of distributors in the region, including drafting and negotiating contracts with distributors and working closely with other cross-functional colleagues as well as with expert functions in International and Global Legal to ensure that all aspects of the distribution relationship are addressed. This will facilitate the development of best practices to be shared with other legal and business colleagues and cross-regional learnings.

To bring a strong command of healthcare regulatory laws, public procurement law, competition law, data privacy law and commercial contracts law (although further support will be available through specialist in-house counsel and external law firms with a well-developed understanding of Gilead and its business.

To have the ability to scrutinise and provide advice concerning pricing and reimbursement decision making processes, commissioning policies and clinical guideline development. In addition, experience of managing litigation and investigations would be valuable.

To work closely with ICR, International and Global Legal and Compliance teams on a wide range of topics.

Continue to strengthen and invest in culture, leadership, and development of Middle East Legal and Compliance Team and implement a healthy allocation of responsibilities within the team to ensure growing self and others.

To effectively manage relationships with external law firms.

Detailed requirements include:

a Juris Doctorate or fully qualified legal credentials in one of more geographies of operations. Fully admitted to practice law in the respective country or jurisdiction.

Extensive (10+ years) professional experience in biotech, pharmaceuticals or other highly regulated industries or law firms advising in relevant areas of practice together with significant experience in an in house setting and particular emphasis on compliance matters

The Legal Director must be an exceptionally strong communicator verbally and in writing, ideally both in Arabic and in English

Ability to operate with a high degree of autonomy and very competently lead in a high performing business environment.

In-depth understanding of business objectives and how those translate into Legal's priorities to deliver practical advice and guidance to the business

Strong business partnering attitude; the maturity and awareness to strike a balance between facilitating, enabling and challenging the business. Experience, confidence, resilience able to establish rapport with key stakeholders

An ability to apply judgement to areas outside of core competency is required. Effectively and practically deliver legal and business advice that mitigates risk with the ability to influence people and defend recommendations throughout the company.

Should be analytical with an ability to pro-actively anticipate areas of risk and initiate efforts to address them.

Capable of acting as a project team leader on multi-disciplinary projects.

Must be able to partner with other departments to achieve company goals that cross multiple functions.

Must be able to navigate the political challenges that arise as multiple departments and different individuals with different skills and interests become engaged on a matter.

Proven experience in representing the Legal function on country-wide or region-wide strategic initiatives and highly complex cross-geography business transactions.

Lead or serve as a strategic member of key legally- oriented projects with high visibility to senior management across Gilead.

Accountable for decisions that may have International and Gilead-wide impact.

Capable of interfacing with a multitude of Company functions to deliver consistent and accurate support and bring insightful analyses and judgement to support the business in making informed decisions.

Proactive counselling to client business partners on potential opportunities and the associated legal and business risks and will be ready to represent International/ICR Legal on legal initiatives that have company-wide impact.

Experience of providing recommendations to HQ legal on complex strategic issues based on independent risk assessment and judgement with the ability to influence decisions of HQ and country leadership to achieve strategic goals.

As a member of the middle East LT, the Legal Director will act as a strategic partner on issues that require both legal, business knowledge and expertise and have the ability to implement global or international legal projects in the Affiliate.

The ability to lead, coach and develop all members of the Legal & Compliance team in the affiliate is a key requirement.
