RESPONSIBILITIES
Strategy
  • Awareness and understanding of the Group\xe2\x80\x99s regional and relevant country business strategy(ies) and ensuring their application by the Legal Function in relevant Middle East markets.
  • Support and collaborate with the Head, Legal Middle East and other members of the Middle East Legal cluster to escalate legal risks, relevant operational risk events, significant, high risk, or complex litigation and to develop effective strategies for identifying legal horizon risks for relevant businesses and in collaboration with relevant business and risk stakeholders, strengthening relationships with regional regulators.
  • Follow the Group Management Responsibility Policy to ensure effective risk management and the implementation of proper controls within the Middle East region and specifically with respect to the Group\xe2\x80\x99s business in Saudi Arabia.
  • Provide proactive advice to the Africa & Middle East (\xe2\x80\x9cAME\xe2\x80\x9d) Regional General Counsel, members of the AME Management Legal team and other relevant committees, on all legal and regulatory issues that have a significant impact on the Bank\xe2\x80\x99s operations in the Middle East, working with external counsel as appropriate (and seek to proactively identify such issues).
Business
  • Escalate product or legal issues, in particular where the PPG or relevant CA parameters or global minimum standards are breached.
  • In collaboration with the regional client and products legal specialist teams in Dubai or Singapore, provide transactional support having regard to relevant PPG/CA parameters and, if applicable the Bank\xe2\x80\x99s minimum standards and guidance for the relevant CF/TB/FM product.
  • Provide quality and effective legal advisory and transactional support having regard to the relevant PPG/CA parameters and, if applicable the Bank\xe2\x80\x99s minimum standards and guidance for \xe2\x80\x9cCore Banking\xe2\x80\x9d products i.e. account opening, basic cash and channels and traditional trade and trade related lending products.
  • Reduce legal and/or client documentation execution blockages for deals originating in the Middle East.
  • Improve awareness, controls and efficiencies around cross border legal issues.
  • Support businesses, credit, middle office teams and the Group Legal, template management team on documentation negotiation issues and the appropriateness of new Group templates for use in the Middle East.
  • Ensure that the use of any non-standard legal templates or supplementary legal templates are justified and streamlined before they are ready for use.
  • Support product business teams across transactional matters/projects.
  • Support middle office teams on documentation queries.
Processes
  • Establish and maintain effective processes (including training, advice and support) to ensure that policies, procedures and standards addressing legal risk are effectively implemented.
  • Act as or assist the Risk Owner for Legal Enforceability risks arising in the Middle East where Group business is undertaken and Legal are instructed to support, or country processes owned by Legal, as set out in the Group\xe2\x80\x99s Risk Management Framework.
People & Talent
  • Promote a culture and practice of compliance with legal standards (including conducting business within legal and regulatory requirements, with high ethical standards).
  • Embed a \xe2\x80\x9cHere for Good\xe2\x80\x9d culture and comply with the Group Code of Conduct.
  • Lead through example and build the appropriate culture and values. Set appropriate tone and expectations from others and work in collaboration with risk and control partners.
Risk Management
  • Within the Group\xe2\x80\x99s Enterprise Risk Management Framework, establish and maintain an appropriate risk-based approach to assessing, measuring, monitoring, manging and reporting Legal Enforceability risk arising across the Bank\xe2\x80\x99s footprint in the Middle East.
  • Act as the Process Owner for any Group or Country processes owned by Legal where such processes are executed. Be responsible for: (i) the management of such processes in line with the Group\xe2\x80\x99s process universe as set out in the Group\xe2\x80\x99s Enterprise Risk Management Framework; and (ii) associated risks, including activities where the processes which are carried out by the businesses or other functions or which are hubbed or outsourced.
  • Act as or assist the Risk Owner for Legal Enforceability risks arising in the Middle East as set out in the Group\xe2\x80\x99s Enterprise Risk Management Framework.
  • Maintain an awareness and understanding of the top risks facing the Group and the role played in managing them.
Governance
  • Awareness and understanding of the legal and regulatory framework, in which the Group operates and the regulatory requirements and expectations relevant to the role.
  • Ensure that Legal is represented at various committees as may be appropriate.
  • Endeavour to ensure that any papers being tabled by Legal at regional governance committees have been reviewed by the regional Legal team and clearly articulate the issues and legal risks involved and any mitigants approached (as appropriate).
  • Work with local regulators (where required to do so) in an open and cooperative manner.
Regulatory & Business Conduct
  • Display exemplary conduct and live by the Group\xe2\x80\x99s Values and Code of Conduct.
  • Take personal responsibility for embedding the highest standards of ethics, including regulatory and business conduct, across Standard Chartered Bank. This includes understanding and ensuring compliance with, in letter and spirit, all applicable laws, regulations, guidelines and the Group Code of Conduct.
  • Lead the ME Legal team to achieve the outcomes set out in the Bank\xe2\x80\x99s Conduct Principles: Fair Outcomes for Clients; Effective Financial Markets; Financial Crime Compliance; The Right Environment.
  • Effectively and collaboratively identify, escalate, mitigate and resolve risk, conduct and compliance matters.

  • AME Legal Management Team, AME Regional General Counsel and Group Legal Management team.
  • Relevant ministries in the Middle East.

Our Ideal Candidate
  • Educational background in Law to degree level/post-graduate & professional studies as necessary to fulfil this role.
  • Qualified international lawyer with minimum 8 years post qualification experience preferably with at least 2-3 years working in an in-house legal team.
  • Exemplary integrity, ethics, independence and resilience- this role requires an enthusiastic and positive mindset and approach.
  • Fluent or professional business level Arabic language and fluent English.
  • Willingness and flexibility to travel and work, specifically to, from and in the Middle East for temporary but regular periods of time.
  • Practically minded, experienced with business related challenges and facilitating resolution.
  • Effective and concise communicator in English and strong contributor/collaborator who is team focused.
  • Sound judgment of business practices, regulatory relationship management and legal and reputational risk; and
  • Robust sense of humour, common sense and perspective.
