Job Description

  • The local and international tax landscapes in which MTN operates have changed.
  • Majority of the operating countries have implemented transfer pricing regulations, the OECD BEPS framework and signed the Multilateral Instrument (MLI). These changes have necessitated the need for robust Transfer pricing documentation for multinationals and additional reporting requirements.
  • In addition to the above, in the last 4 years, the UAE had undertaken the following major changes in its landscape:
  • Introduction of VAT in 2018;
  • Signed the MLI and tax information exchange agreements;
  • Rolled out Country-by-Country (CbC) Reporting regulations and Economic Substance Regulations (ESR) in 2019; and,
  • Introduced a corporate income tax regime in December 2022, including substantial TP rules.
  • MTN has also gone through changes in its business model and continues to evolve to maintain its competitiveness in the industry.
  • In this context, the Transfer Pricing Manager will be expected to support the existing team in ensuring that the business is operating in alignment with the group tax strategy and policy and is compliant with transfer pricing regulations.

3. Key Performance Areas: Core, essential responsibilities / outputs of the position (KPA\'s)

  • Understand Global Connect transfer pricing policy; develop the process for implementation; and ensure its proper implementation.
  • Review and analyse all intergroup transactions between Global Connect and other MTN entities and report on gaps with policy.
  • Report on Global Connect transfer pricing compliance on monthly basis. The Manager will also be required to report quarterly to the Global Connect audit committee.
  • Support pricing committee for Global Connect in reviewing the pricing of products to ensure the prices are aligned to the transfer pricing policy. The Manager will also r eview price book to ensure its compliance with the transfer pricing policy.
  • Managing the preparation of transfer pricing templates, to be used by the OPCOs to document inter-company transactions with Global Connect.
  • Assist the OPCOs with filling in the above transfer pricing templates, upon their request.
  • Document and maintain up to date Global Connect benefit analysis for use in getting local regulatory approvals in liaison with the beneficiary OPCOs.
  • Liaise with OPCOs to address tax concerns regarding Global Connect services and payments.
  • Monitor and identify pro-actively potential transfer pricing issues and opportunities for Global Connect business.
  • Develop and implement processes for aggregating corporate direct and indirect costs that relate to support services provided to subsidiaries, allocating corporate costs consistent with transfer pricing principles, communicating and confirming cost allocations to be reported in tax returns accurately across the global group in reference to GlobalConnect.
  • Review transfer pricing return filings for OPCOs.
  • Assist Dubai Group Tax team in preparing the TP documentation for the Dubai OPCOs.
  • Assist in developing the transfer pricing policy and documentation for the UAE based entities, in line with the new TP regime.
  • Assist the Dubai Group Tax team on an adhoc basis on other TP and tax matters for the group.

4. Job Requirements (Education, Experience and Competencies)

Education: Bachelor\xe2\x80\x99s degree in either Finance, Commerce Accounting/Tax certification \xe2\x80\x93 CPA, ACCA, CTA, ADIT English French /Arabic not required but advantageous
Experience: Minimum of 5 years in transfer pricing in consultancy or in-house in a multinational group Telecommunication experience is desirous but not mandatory Experience in diverse cultures and geographies Excellent communication skills across verbal, written and presentation skills
Competencies: Knowledge:
  • Knowledge of OECD TP guidelines
  • Knowledge of tax contracting and structure
  • Knowledge of Transfer Pricing laws across Middle East and Africa
  • Computer literacy especially in MS Office
